Real Estate Law:

Real estate transactions can be challenging, whether purchasing or selling a home; acquiring properties for investment, rehab or resale; purchasing a foreclosure property; establishing or negotiating commercial or small office leases; or reviewing the terms of a development offer on a large tract of land or acreage.  Even if you are represented by a real estate agent (or broker), although they can provide significant guidance through the transaction, they cannot provide legal advice.  In some cases, this will leave some of your most important questions and concerns unanswered.  Brad Boyd and the law firm of Thomsen Nybeck, can help provide the missing link.

Additionally, many Minnesota landowners, farmers, and communities will be facing proposals and decisions in the near future related to the possible development of wind farms or wind energy communities. Although alternative energy in general and wind energy specifically have extraordinary benefits for individuals, communities and the environment, navigating through the structure and negotiation of such projects can be difficult without proactive legal counsel.  Considering the advantages and disadvantages of various easements, option agreements, purchase agreements, and wind development agreements should be something each party involved has appropriate time and resources to evaluate, and contacting Brad Boyd or another attorney to consult in such matters is likely very worthwhile.

Brad Boyd can provide legal counsel for the following real estate matters:
  • Agency relationships and advice in working with a real estate agent or on your own in the purchase or sale of a home
  • Drafting or reviewing contracts or residential purchase agreements to ensure your real estate purchase or sale is as smooth and obstacle-free as possible
  • Conveyances (transfers of real estate through deeds, transfers in and out of trust or business ownership, etc.)
  • Legal representation, purchase agreement assistance, closing representation or advising for FSBO (For Sale by Owner) sellers
  • Reviewing, drafting, or negotiating terms of commercial or residential leases, including small office leases
  • Offering advice, counsel, drafting or review in wind energy projects, wind energy leases, easements, option agreements and other project negotiation
  • Assisting real estate clients with business formation, entity selection, and assessing potential risk areas
  • RESPA advising and risk avoidance, including affiliated business disclosures
  • Tenancy agreements for co-ownership of property
  • Assisting with title matters (including helping determine or clear objections to title)
  • Legal advice, contract review, and representation for individuals or agents involved in "dual agency" real estate transactions

Agents, Brokers, Realtors:  Brad Boyd and the law firm of Thomsen Nybeck, PA, has advised many real estate agents, brokers, and investors - see our Agents & Brokers page for more info.

Landowner Representation in Wind Energy Proje
cts
:

Minnesota is a very progressive state for the development and utilization of wind energy as a renewable and sustainable energy resource.  Wind energy development and wind farms can be managed and developed by individual landowners, although that tends to have significant cost and resource requirements beyond what many individuals are comfortable with.  Community wind projects and development by commercial wind development enterprises create economies of scale and have the benefit of shared risk, shared reward, and shared knowledge/resources.

Since many individuals, communities, and farmers will be considering wind projects or approached by wind energy developers, it is important to know who you will turn to when you are looking for advice and counsel to assist you through the legal issues, pitfalls, and strategies that you will want to discuss as you are evaluating your options.  Brad Boyd can provide legal counsel in connection with such projects, and you are welcome to contact Brad to discuss representation.

Residential Buyer or Seller Representation:

If you are buying or selling a home, there are significant risks and legal consequences to an offer you make or accept, how a purchase agreement is best drafted to protect your interests, and what effect various contingencies have on the sale.  Even if you have a REALTOR or real estate agent involved, they can offer invaluable help in the transaction, but cannot provide legal advice - in a transaction as emotionally and financially significant as the purchase or sale of a home, you may want to consider how an attorney familiar with Minnesota real estate law and transactions can help guide and advise you through the legal issues involved.

For a checklist identifying how a real estate attorney can help you through a home purchase or home sale, please review the buyer and seller guides below:
